The Department of Homeland Security (DHS) under President Joe Biden estimated that up to 390,000 illegal aliens will show up at the U.S.-Mexico border every month if Title 42 border restrictions are ended on May 11.
According to a proposed federal rule from the Office of Immigration Statistics, encounters with illegal immigrants “could average 11,000 to 13,000 per day after the lifting of the Title 42 public health order, absent additional policy changes.” Multiplying that number by 30 days, it will translate to a monthly total ranging between 330,000 and 390,000. In addition, it is likely that tens of thousands of illegal aliens would slip past Border Patrol and successfully enter the U.S. without being detected.
Former President Donald Trump invoked Title 42 back in 2020, at the height of the Wuhan coronavirus (COVID-19) pandemic. Under this edict, federal immigration officials could quickly deport illegal aliens to Mexico for posing a threat to public health. The Biden administration later attempted to end Title 42 last May but was prevented from doing so by the Supreme Court. However, the administration now seeks to end Title 42 on May 11 of this year, alongside the lifting of the COVID-19 public health emergency.
Alongside this, the DHS’ proposed federal edict – which would replace Title 42 when it ends – would include rejecting asylum claims from illegal aliens who had already passed through countries with robust asylum systems. Migrants wanting to enter the U.S. would be encouraged to arrive at points of entry for scheduled appointments, which would secure them parole.
Back in April of last year, Rep. Andy Biggs (R-AZ) made a similar projection about the number of migrants arriving if Title 42 is lifted during an interview on “Breitbart News Saturday” that month.
“Right now, the DHS’ number is about 8,00 people a day illegally entering our country,” he said. “They say it’s going to be 18,000 a day [when Title 42 ends]. I personally think it’s going to be 20,000 to 30,000 a day.”
“It’s going to be dramatic. If you think it’s bad now, the tsunami that’s coming is going to be overwhelming.”
In a bid to stem this projected tide of illegal immigration and secure the border, Rep. Mark Green (R-TN) joined his colleagues to convert Title 42 from an authority to COVID-19 to fentanyl. Aside from addressing illegal immigration and border security, the plan also sought to address the fentanyl crisis that continues to claim the lives of more than 100,000 Americans yearly.
“It’s hard to make the argument that COVID-19 … is a reason for Title 42 to be employed,” he told Main Street Nashville.
Green, the chairman of the House Committee on Homeland Security, continued: “Let’s face it. Fentanyl is coming is coming across the border and 107,000 Americans died last year. That’s over a billion over the course of 10 years, if my math is correct. So that’s a crisis. That’s a healthcare crisis.”
The congressman for the Volunteer State also lamented how the Biden administration is not using Title 42 properly. He said: “Obviously, they’re not executing the Title 42 rulings in an appropriate way. Everything that the president has done has been to speed people into the country.”
Green is not the first lawmaker to put forward the proposal, however.
Back in May 2023, Sens. Bill Hagerty (R-TN) and Joni Ernst (R-IA) proposed the idea of converting Title 42 to address the fentanyl crisis. Hagerty went as far as to introduce a plan that would do just that, but found himself blocked by Sen. Brian Schatz (D-HI) and other Democrats.
