The Daily Caller has uncovered a direct line between President Joe Biden’s administration and former President Donald Trump’s name being barred from showing up on the Colorado Republican Party’s presidential primary.
This comes as most people and news outlets reviewing Trump’s case in Colorado are focusing on the fact that Democrats appointed all seven members of the Colorado Supreme Court. (Related: BREAKING: Colorado Supreme Court disqualifies Trump from appearing on state’s primary ballot.)
According to an investigation conducted by Daily Caller reporter James Lynch, the organization responsible for bringing the Colorado case against Trump is the Citizens for Responsibility and Ethics in Washington (CREW).
Noah Bookbinder, CREW’s president and CEO, currently serves on the Department of Homeland Security’s Homeland Security Advisory Council (HSAC), which is tasked with providing Homeland Secretary Alejandro Mayorkas with real-time advice. Bookbinder was appointed in March 2022.
“Our Constitution clearly states that those who violate their oath by attacking our democracy are barred from serving in government,” said Bookbinder in a press release, alluding to Section 3 of the 14th Amendment, or the insurrection clause, which is the very clause that the Colorado Supreme Court argued bans Trump from holding the presidency. “It has been an honor to represent the petitioners, and we look forward to ensuring that this vitally important ruling stands.”
Mayorkas met with HSAC numerous times in meetings that discussed issues such as so-called disinformation, supply chains and innovation. The council’s latest meeting was in September and Bookbinder himself was in attendance.
CREW Executive Vice President and Chief Counsel Donald Sherman argued that the organization “brought the right case in the right place at the right time in order to prevail on the merits.”
The Colorado Supreme Court’s argument for banning Trump rests on the false idea that the former president incited an insurrection on Jan. 6, 2021. This same argument is being used by one other Biden-linked group in multiple other states to prevent Trump’s name from appearing on Republican primary and general election ballots.
This group is known as Free Speech For People (FSFP). Both it and CREW are not only directly linked to Biden but are also heavily financed by liberal donors who support the current president. This connection has made Trump himself blame Biden for the multiple lawsuits attempting to prevent him from running for a second term.
One case in Minnesota was decided last month when the state’s supreme court argued that the Minnesota Republican Party and all other state political parties are free to put anybody they want on their primary ballots. This verdict dismissed FSFP’s Section 3 lawsuit but left the door open for the group to bring the lawsuit up again during the general election.
In Michigan, another 14th Amendment case was struck down before it could reach the state supreme court, with the judge arguing that Congress, not the judiciary, gets the final say in whether or not certain candidates can stay on the ballot or must be removed. FSFP is appealing this ruling.
Litigation is pending in at least 12 other states, including crucial swing state Arizona. The next state expected to rule on the matter is Maine, where the state’s Democratic secretary of state is expected to make a declaration on Trump’s eligibility in the coming days.
Sherman noted that he is not as hopeful about the chances of lawsuits succeeding in other states as they may not have the same conditions for legal success.
“It really depends state by state on what the state law looks like, what relief voters can see in the courts, what jurisdictional authority courts or the secretary of state have,” said Sherman. Still, he believes the Colorado court’s findings are relevant enough that judges in other states “may find it relevant as well.”
“The Colorado decision will have a major impact,” said FSFP co-founder and president John Bonifaz, who noted that the Colorado suit shares many of the same legal questions that FSFP is pushing in other states. This includes the question of whether the 14th Amendment applies to Americans running for president and whether courts can enforce the insurrection clause even without congressional legislation.
“We now have a definitive, for the first time, state supreme court ruling on those questions,” said Bonifaz. “And we think it’s applicable to these other states.”
